TRANSITIONS....How did I get here?
Having spent 44 years as a real estate litigator and transactional lawyer, and after several major life events, I decided a few years ago to “semi-retire” from the practice of law and focus my efforts on my life-long love: real estate. So, I sold my interest in the firm and, as of December 31, 2018, I am no longer involved in the day-to-day practice of law. I will continue to represent a few select clients as necessary, but that will likely diminish over time. Instead, I will be focusing on building and nurturing my real estate sales practice.
I’ve been involved in real estate since I was a boy. My dad was a broker. He had me change out the weekly “listing slips” in the listing book. (No computers back then). I remember him talking on the phone with one fellow, discussing how a particular house had at least $2,000 in equity, as if that were a big deal! (I had no idea what “equity” meant). Well, it was a big deal back then, when homes were selling for only $15,000. So, now I get to work in the field that I have always loved so much.
I have been a licensed real estate broker since 1980. I taught the real estate brokering course at both De Anza Community College and at San Jose State University, and I co-authored the text book for the course. During the course of my legal career, in addition to representing clients in hundreds of complex real estate sales and financing deals, I have also brokered a number of different types of properties, including residential, shopping centers, and industrial buildings.
I am really looking forward to helping a new set of clientele, and my old clientele, with their real estate needs. Should you find yourself in need of an experienced person in both real estate sales and real estate law, I hope you consider what I have to offer.

Mr. Kelly has been an attorney in the Santa Clara Valley focusing on the fields of litigation, bankruptcy and real estate (both litigation and transactional) since 1976. A licensed real estate and mortgage broker since 1980, Mr. Kelly has been an instructor in real estate brokerage at San Jose State University located in San Jose, California, and De Anza Community College located in Cupertino, California. A summa cum laude graduate of Santa Clara University School of Law, he was senior counsel for, and former shareholder of the law firm of Adleson, Hess & Kelly, P.C., since 1978. He now has the time to pursue his love of real estate and to implement his skills in negotiating, documenting and selling real estate. His career includes sales of both residential and commercial real estate and property leasing.
Mr. Kelly has earned an AV® Preeminent™ 5.0 out of 5.0 Peer Review Rating, the highest available rating for legal ability and ethics, as recognized by Martindale-Hubbell, Inc. Since 1982, Mr. Kelly has spoken at numerous real estate and bankruptcy industry and professional seminars, focusing on the subjects of bankruptcy, foreclosure law, real estate financing and related legislation. Since 1984, his practice has included drafting and reviewing California legislation relating to lending and foreclosure which has become law. The legislative activity was undertaken on behalf of the United Trustees Association (formerly, California Trustees Association) and the California Mortgage Association. He has been utilized as an expert witness in the field of bankruptcy and real estate and is often asked to provide expertise to counsel and their clients.
He is the author of numerous articles relating to the fields of real estate, bankruptcy, real estate financing and foreclosure. He is co-author of a book formerly used in training real estate brokers for the California real estate brokerage exam.
Mr. Kelly's legal practice focused on representation of real property secured lenders in litigation forums of all types. He represented many parties involved in real estate financing, leasing and sales, including sales. leasing and financing of commercial, office, industrial, multi-family, and residential properties. He also represented parties in business transactions. He has been retained as an expert witness in real estate and bankruptcy matters. In his lengthy career, he had numerous successes, including many appellate case victories.
He was married for nearly 48 years until widowed, raised a family, has grandchildren, participated in sports for decades, and has served on numerous community boards and organizations.
